Terms of registration
By registering for the UTS Info Day to be held on 18 December (the “Info Day”) you confirm your agreement to the following terms and conditions (“Terms”). These Terms are agreed between University of Technology Sydney, ABN 77 257 686 961 (“UTS”, “we”, “our”) and the person registering for the Event via this website (“you”, “your”).
In consideration of our accepting your registration for the Info Day, you acknowledge and agree that:
1. UTS Info Day will be held on-campus. To participate in UTS Info Day, you will need to register with the Humanitix platform (the “Platform”), via your internet browser. Please note that the Platform is owned and operated by a third party licensor and not UTS.
2. If a parent or legal guardian wishes to accompany you to physical events, they will need to register as well.
3. To the fullest extent permitted by law:
- UTS excludes all warranties as to availability or performance of the Humanitix platform, and does not guarantee the availability of spaces for any Info Day activities;
- UTS shall not be liable for any loss, damage, cost or expense (“Loss”) suffered or incurred by you arising from your attendance at or participation in Info Day;
- Where we are unable to exclude our liability for Loss in accordance with clause 6(b) of these Terms, our total aggregate liability to you for all Loss arising in connection with your attendance at or participation in the Info Day shall not exceed $100 (one hundred dollars); and
- In no event will UTS be liable to you or any other person for Loss not arising as a natural, foreseeable and direct consequence of our acts or omissions.
4. No intellectual property rights in the Platform or any content made available to you on the Platform or otherwise in connection with the Info Day shall be transferred to you. All such intellectual property rights remain vested in UTS and/or its licensor.
5. You represent that you have the right to submit information to UTS and/or its licensors, including any personal information provided by you or on your behalf.
6. Other than as we expressly agree to in writing, you must not:
- use the Info Day to disseminate any materials:
(i) which constitute, encourage, enable or facilitate content or activities of a sexual nature;
(ii) which constitute, encourage, enable or facilitate hate speech, discrimination, defamation, harassment, or physical harm to any person; or
(iii) which are unlawful, morally questionable, unsuitable for minors or which otherwise would reasonably be regarded as offensive,
and you acknowledge and agree that in the event you do any of the above things, your right to participate in the Info Day may be summarily withdrawn.
7. If a provision of these Terms is held by a court of competent jurisdiction to be illegal or unenforceable, it may be severed without affecting the enforceability of the other provisions of these Terms.
8. These Terms are effective upon your registration for the Info Day and will continue in force until the later of (i) the Info Day and (ii) your last use of the Platform. All rights and obligations in these Terms which are of a continuing nature shall survive termination or expiry, including but not limited to those provisions relating to liability and intellectual property.
9. These Terms and all matters arising under or in connection with them will be governed by the laws of New South Wales. You and we each submit to the exclusive jurisdiction of the courts of New South Wales and courts with jurisdiction to hear appeals from those courts.
